In a developing story that has captured the attention of the sports world, Andrea Trischan, the former program manager of diversity, equity, and inclusion (DE&I) for the Phoenix Suns, has filed a formal complaint with the U.S. Equal Employment Opportunity Commission and the Arizona attorney general's office's civil rights division. The complaint, which includes serious allegations of wrongful termination, seeks $60 million in damages.
Tenure and Allegations
Trischan’s tenure with the Suns spanned from September 2022 to July 2023, a period marked by significant internal upheaval, including the suspension of former owner Robert Sarver due to findings of inappropriate workplace conduct. Trischan’s complaint alleges that she endured overtly racist comments and a hostile work environment, contributing to a climate that she describes as toxic and unaddressed by the organization's leadership.
According to Trischan, her concerns were particularly focused on the organization’s decision to appoint several executives accused of misconduct to a newly established diversity council. These apprehensions were communicated to Kim Corbitt, the head of HR for the Suns, yet they seemingly went unheeded. Furthermore, Trischan claims she was placed on a performance improvement plan in late May 2023 and was ultimately fired in July 2023, a move she views as retaliatory.
Official Responses
The Phoenix Suns have categorically denied any wrongdoing and have responded robustly to the allegations. Stacey Mitch, the senior vice president of communications for the Suns and Mercury, issued a statement clarifying the organization’s stance.
"A former employee who last worked for the organization in 2023 was terminated after less than 10 months due to repeated failure to perform her job duties," Mitch commented. She further elaborated, "This individual filed a baseless charge with a state agency and is now trying to use ESPN reporting from 2022, specific to previous ownership, to make egregious claims in order to support her ridiculous demand for $60 million from the Suns organization."
Diversity Council Controversy
The newly established diversity council has also been a point of contention. Trischan’s concerns about the council included the appointment of executives previously accused of misconduct. In defense, a spokesperson for the Suns clarified the objectives and structure of the council:
"Ms. Trischan's claims regarding the diversity council are misleading. The purpose of the diversity council, which is comprised of the entire executive team and other leaders in the organization, is to listen to the diversity data and information on DE&I initiatives to continue to further the organization's DE&I commitment."
Legal Proceedings
Trischan's legal journey is being navigated with the help of her attorney, Sheree Wright. Reflecting on her client’s experiences, Wright stated, "[Trischan] endured overt racist comments and a hostile work environment that went unaddressed despite being reported to HR and executive leadership."
Meanwhile, the Suns have highlighted their ongoing participation in the review by the Arizona Civil Rights Division (ACRD). "The Suns continue to participate in the [Arizona Civil Rights Division] review in good faith. We are confident that after the ACRD completes its review of Ms. Trischan's charge, the ACRD will confirm that Ms. Trischan's claims are factually and legally baseless," expressed a Suns spokesperson.
Ownership Changes
The backdrop to these allegations includes notable changes in the Suns' ownership and executive leadership. Jason Rowley, the former team president and CEO, resigned in February 2023. Coinciding with this leadership exit, Mat Ishbia's purchase of the Phoenix Suns was finalized, signaling the start of a new chapter for the embattled franchise. However, Trischan’s allegations suggest that the cultural and operational reforms promised by the new leadership may still face significant challenges.
As the legal proceedings unfold, both parties stand firm in their convictions, setting the stage for a potentially lengthy and high-profile legal battle. The outcome of this case could have profound implications not only for the Phoenix Suns but also for organizational practices within professional sports teams at large.
What remains undeniable is that Trischan’s allegations and the Suns’ staunch defense have spotlighted significant issues concerning workplace culture, diversity, and leadership accountability in sports organizations—a narrative that continues to evolve with each passing day.
